BIRCH LEGAL’s IP practice successfully concluded the legal dispute over the termination of the "SETKA" trademark’s registration.
Our client, HeadHunter, is currently launching a large-scale online project, Setka, which is intended to become a new social network for building professional connections and networking. However, the registration of the social network name Setka as a trademark was prevented by a similar trademark "SETKA" of a third party, which jeopardized the possibility of our client using the chosen name Setka for the new online project.
In court, our opponent, on whose behalf several representatives participated in the hearings, took a very active position: he repeatedly presented large volumes of evidence and numerous written explanations, filed demands for interim measures and challenged the refusal to accept them in the Presidium of the Intellectual Property Court, which slowed down the trial.
Despite the opponent’s active resistance, we managed to prove the fact of non-use of the disputed trademark as well as terminate its protection, thereby allowing the HeadHunter company to register the trademark "SETKA" under its name and use it during the full-scale launch of the Setka social network.
