Evgeny has been advising and representing clients in commercial, environmental, product liability and technology disputes for more than twenty years, as well as disputes involving state bodies.

Evgeny has impeccable analytical and advocacy skills. A number of his court cases are precedent-setting and have changed the Russian legal landscape, and he regularly testifies in foreign courts as a Russian law expert.

Evgeny is an attorney at law admitted to the Moscow Bar Association (Chamber of Attorneys at law) and holds a PhD in Law.

Legislative work

Drafting the Recommendations for Compliance with the Laws on Advertising Non-Prescription Medicines jointly with the Association of International Pharmaceutical Manufacturers (AIPM), Association of European Businesses (AEB), Association of Russian Pharmaceutical Manufacturers (ARPM), Society of Professional Pharmaceutical Organizations (SPFO), Russian Association of Communications Agencies (AKAR) and the International Confederation of Consumer Societies (KonfOP) while receiving support from the Federal Antimonopoly Service of Russia (FAS of Russia). The Recommendations were signed on 7 November 2018.

Experience

• acting for a Skolkovo resident (Double Data) in a high-profile, precedent-setting dispute against the VKontakte social network over use of Big Data and the functioning of search engines. The case has evolved into one of the most talked about disputes in recent years over use of Big Data and the functioning of search engines. The Court for Intellectual Property Rights approved the settlement agreement (2021) (Evgeny was one of the representatives of Double Data before he joined BIRCH LEGAL)

• acting for pharmaceutical company in a case on the recovery RUB 1,8bn from the client under the contract in connection with the phrase “not including tax (if applicable)”

• supporting throughout the Russian part of three major disputes in LCIA (London)

• acting for the client in a case for the recovery RUB 650m from the opponent under a suretyship agreement

• acting for an international confectionery producer defending it in relation to the lawsuit of the public prosecutor to demolish the client’s factory due to a violation of the sanitary protection legislation
