Amendments to the State Commercial (Arbitrazh) Procedural Code

In the beginning of January, changes to the State Commercial (Arbitrazh) Procedural Code (SCPC) came into force. The BIRCH LEGAL Dispute Resolution Team, Partner Evgeny Oreshin, as well as Junior Associates Daria Bilyk and Ivan Tebenev, have reviewed the recent changes.

We briefly describe the most relevant amendments:

  1. The maximum period of adjournment in a court hearing has increased from 5 days to 10 days.
  2. It is now impossible to appeal against court rulings on the application of interim measures. In order to lift interim measures, it is necessary to file a motion for their cancellation with the court that imposed them. It is still possible to appeal against the refusal to impose interim measures.
