Dividends being included in the customs value of imported goods: the current status of investigations and practical recommendations for passing them

In August 2023, the FTS of Russia started to investigate the inclusion of dividends into the customs value of imported goods.

Program

A wide range of companies that carried out activities from 2021 to 2023 on the import of goods into Russia which were purchased from the parent company followed by the subsequent distribution of dividends to such parent company have already received or will receive the corresponding requirements for the provision of documents (information).

As expected, the requirements (requests) include a wide range of accounting and tax accounting documents that are actually related to the formation of revenue in the Russian Federation, determining the percentage of imported goods in the company’s profit, information on dividend payments, etc. For several requirements, the customs authorities go further and immediately request the completion of an additional form containing a table in which the declarant must independently include dividends in the customs value of goods previously imported.

Despite the pressure applied by the customs authorities, our experience has shown that properly constructed factual arguments, calculations and indicators supplemented by legal grounds are accepted by the customs authorities, and the declarant may avoid significant additional charges.
